11:00 AM – 12:00 PM | Pushing The Envelope: Navigating Fair Use In The Golden Age Of Media
1.0 Hour MCLE
In this golden age of film, television, and interactive entertainment, creators have to surmount incredible obstacles to finance, produce, and distribute original content. Telling a compelling narrative, whether true or imagined, usually requires the use of music, artwork, photographs, videos, and other existing materials protected by copyright. While obtaining a license may appear to be the safest bet, sometimes permission is not possible to obtain, too expensive, or impractical. Fair use offers an alluring alternative, but with massive copyright damage awards painting the headlines and the Supreme Court weighing in on transformative use for the first time in almost 30 years, is fair use really viable? Join us for this exciting panel as copyright and entertainment lawyers discuss the role of fair use in the golden age of media.
Speakers:
- Lisa A. Callif, Partner, Donaldson Callif Perez, LLP
- Jeremy S. Goldman, Partner in the Litigation Group, Frankfurt Kurnit Klein & Selz PC
1:15 PM – 2:15 PM | Deep Waters: Navigating a Copyright Termination and Recapture Case…and Beyond
1.0 Hour MCLE
Copyright termination and recapture under 17 U.S.C. Sections 203 and 304 is a complex process filled with traps for the unwary. And while allowing artists to recapture their rights is valuable, does recapture effectively address the inequality between artists and the distributors of their works that exists in copyright law? Copyright termination/recapture is at issue in films (“Top Gun Maverick”, “Friday the 13th”, “Predator“, Marvel characters), and musical works, including 2 Live Crew, and class actions against major record labels. Join two prominent law professors in this field to discuss these complicated issues: Marc H. Greenberg, author of Copyright Termination and Recapture Laws: Good Intentions Gone Awry (ABA Publishing, 2016), and Kevin J. Greene, who is widely recognized for his pioneering work on African-American music and inequality in copyright law, including his unique perspective on copyright termination, as discussed in his recent article The Future is Now: Copyright Terminations and the Looming Threat to the Old School Hip-Hop Song Book (Journal of the Copyright Law Society, 2021).
Speakers:
- Marc H. Greenberg, Professor of Law and Founding Director of the IP Law Program, Golden Gate University School of Law, San Francisco, CA
- Kevin J. Greene, John J. Schumacher Chair and Professor of Law, Southwestern Law School, Los Angeles, CA
2:15 PM – 3:15 PM | Modern Influencer Agreements: Understanding Legal Issues in Working WIth Influencers
1.0 Hour MCLE
Social media influencers are a lucrative avenue for internet advertising-an avenue that comes with a variety of complex legal considerations. Join Denise Howell and Hannah Taylor for a discussion on how to approach influencer and micro-influencer contracting, either from the side of the influencer or from the side of the business. Hannah and Denise will explain how the rising tide of the creator economy can douse Fyre Festival flames and lift all boats. Look forward to learning about FTC regulations, specific industry needs, and practice tips that will help prepare you to represent an influencer, or help your client hire one safely.
Speakers:
- Denise Howell – Internet and Technology Lawyer, Host + Contributor, Twit.tv
- Hannah E. Taylor – Frankfurt Kurnit Klein + Selz, PC – Partner and Co-Chair of Advertising, Marketing, Public Relations, and Blockchain Technology Groups

- What is substantial similarity in music and why does the doctrine exist to determine infringement?
- How do courts determine substantial similarity of musical works and what proof is required?

- How did the 9th Circuit en banc decision in Skidmore v. Led Zeppelin affect substantial similarity going forward?
- Are there better alternatives and how would they work?
