We are honored to present the first-ever California Privacy Lawyer of the Year award to Lisa B. Kim, Deputy Attorney General, Privacy Enforcement & Protection Unit of the California Department of Justice. Ms. Kim has played a pivotal and influential role in drafting regulations to implement the California Privacy Rights Act amendments to the California Consumer Privacy Act.

California’s Age-Appropriate Design Code Act passed just a few months ago and will not be effective for another year, but it already has the privacy and business communities up in arms, with some pondering whether it will actually “break the Internet” as we know it today.  This panel will feature Michael Murray, Head of Regulatory Strategy at the UK’s Information Commissioner’s Office, who we hope will help us all mellow out about the impending law, as he discusses how implementation of the UK’s Age Appropriate Design Code (a model for the California law) has been going and walk us through key issues including age assurance, privacy impact assessments, and more. Bring your questions – we have saved time for them!

Issues surrounding health privacy exploded in 2022, both at the federal and state levels. The Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization spurred a flurry of advisories and policy statements from the federal government; the FTC and HHS focused on privacy issues associated with health apps not covered by HIPAA; lawsuits focused on the use of advertising pixels on hospital websites proliferated; and California amended its health privacy law. Our panel of health and privacy experts makes sense of these recent development and opine on the broader landscape of medical privacy.

In addition, new EEOC regulations and pending rules from California’s fair house and employment agency and other regulators around the country are putting into focus the use of automated decision-making tools in the employment context and introducing new regulatory requirements and compliance risk.. Ransomware continues to be one of the fastest growing cyber-attacks, with an almost 13% rise this year according to the 2022 “Verizon Data Breach Investigations Report” – an increase as big as the last five years combined. Meanwhile, cybersecurity is also a key area of regulatory focus, with the US Federal Trade Commission (FTC) seeking public comments in August 2022 on its proposed rulemaking on data security and the US Securities and Exchange Commission (SEC) reopening the public comments period on its proposed security incident disclosure requirements for public companies in October 2022. This session focuses on on how businesses can maintain reasonable security and prepare for the worst.

The privacy rights of children and teens have been front of mind for parents for some time, and regulators and lawmakers are catching up.  California recently passed a version of  the UK’s Age Appropriate Design Code and other states have introduced similar bills; the FTC has stepped up COPPA enforcement (including most recently in the gaming space) and issued several policy statements around protecting kids’ privacy; and several children’s privacy bills were advanced in the most recent session of Congress.  Our experts will address these developments and discuss how to navigate in this area of increased regulatory scrutiny and risk.

Focus on the “metaverse” and the development of immersive tech will only increase in 2023, with the planned introduction of Apple’s long-awaited AR and VR products, developments at Meta, and continued expansion of platforms like Roblox that are already bringing users into virtual spaces.  As these technologies proliferate, regulatory scrutiny will undoubtedly increase and privacy issues are expected to be front and center.  Our privacy experts have been swimming in the metaverse and virtual reality waters for some time and will walk us through the top privacy issues and regulatory concerns in this area and how they are being addressed.
