Webinar: Avoiding Legal Malpractice and Ethical Violations for Trust and Estate Attorneys

Kristin Yokomoto, Member of the CLA Trust and Estate Executive Committee (TEXCOM); Scott Garner, Vice-Chair of the CLA Ethics Committee; and Suzanne Burke-Spencer, Chair of the CLA Ethics Committee will discuss ethical violations and other acts and omissions that trust and estate planners and litigators make that can lead to malpractice exposure. They will discuss recent cases involving careless and negligent attorney actions that have resulted in malpractice claims. This panel will also cover when attorneys owe duties to non-clients and when heirs and beneficiaries can sue for malpractice.

Scott Garner, Esq., is a partner at Umberg Zipser LLP, in Irvine, California. He practices in the areas of complex business litigation, with a focus on lawyer liability matters, legal ethics counseling, and State Bar disciplinary defense. Scott is the Vice Chair of the CLA Ethics Committee and Co-Chair of the Orange County Bar Association Professionalism & Ethics Committee. He is the former Chair of the State Bar’s Standing Committee of Professional Responsibility and Conduct (COPRAC) and a past President of the Orange County Bar Association. He frequently testifies as an expert on legal ethics and standard of care.
Suzanne Burke-Spencer, Esq., is the managing shareholder at Sall Spencer Callas & Krueger in Laguna Beach, California. She practices in the areas of professional malpractice and attorney ethics as well as complex business and real estate litigation. Suzanne is a Specialist in Legal Malpractice Law certified by the State Bar of California. She is the Chair of the CLA Ethics Committee, Co-Chair of the Orange County Bar Association Professionalism & Ethics Committee, and a member of the Board of Directors for the Orange County Bar Association. She is the former Chair of the State Bar’s Standing Committee on Professional Responsibility and Conduct (COPRAC).
Kristin Yokomoto, Esq., is a partner at Baker & Hostetler LLP in Costa Mesa, California. She practices in the areas of estate planning for high net worth clients, business succession planning, trust administration, and probate. She is a Legal Specialist in Estate Planning, Trust & Probate Law certified by the State Bar of California. Kristin is a Fellow of the American College of Trust and Estate Counsel (ACTEC), Executive Committee Member of the CLA Trust and Estate Section (TEXCOM), and Member of the Orange County Bar Association Professionalism & Ethics Committee.
